The Deferred Prosecution program monitors compliance with the conditions imposed by a deferred prosecution order, which allows an offender diagnosed with alcohol addiction and who fully accepts the need for treatment to undergo a two year treatment program. Upon successful completion of the program, the charge is dismissed. Although the program is used primarily for DWI cases, it may also be applied for other specified offenses and for offenders with drug addiction and mental health problems. Recent legal changes limit an offender to one deferred prosecution in a lifetime. Currently there are approximately 1000 active deferred prosecution cases in Clark County.
