There are different levels of severity depending on how many times you get charged for drunk driving. For example if you get charged for a DUI for the first, the fine will be between 150 dollars and a thousand dollars, depending on the judge and the circumstances. For the second offense, the fine is at least 400 dollars and could even go as high as three thousand dollars if the situation warrants it. The fine goes on increasing when you get a third DUI offense, the price to pay would be at least 900 dollars and the maximum fine is 5000 dollars.
Another area where the penalty increases is for the mandatory jail time, on the first offense, the judge could sentence the person from a day to a full year in jail. If they still haven’t learned their lesson and get charged for a second DUI, the mandatory jail time is a full week, but then again the law officials could sentence the offender to over 365 days of jail time. But the offender could have to do 30 days of community service instead of jail time. When it gets to the third DUI charge, the offender will have to go to jail for 90 days at least or perform the equivalent number of days in community service. The fourth DUI conviction gets the offender imprisoned for a minimum of a year but it could go up to 6 years. But if the court warrants it, it could be replaced by a full year of community service.
There is also a part of the law in Arkansas that covers the taking of the blood or breath test for BAC. Residents of Arkansas when getting their license to operate a car, give their consent to undergo either a urine test, blood test or a breath test so that their system can be checked for alcohol or drug. If the driver refuses to provide the necessary elements for the officials to conduct the test, their license will be suspended for a period of 180 days, no exception. So people addicted to alcohol or drugs are subject to the same laws.
There is also a special kind of penalty if the offender was driving drunk while there was another person under the age of 16 in the vehicle. This factor affects mostly the jail sentence that the offender would have to serve. For the first offense, the mandatory jail time under those circumstances is seven days, and it could easily go up to a year of prison time. On the second offense, a month of mandatory jail time or a minimum of two months of community service is required. The third time gets the offender a sentence of 120 days in jail or its equivalent in community service. The fourth DUI offense of this kind gets the person a minimum of two years in jail, but then again the court could decide that the offender do community service for two years instead of going to prison.
