DUI California Drug & Alcohol Rehab Treatment

California State has some specific rules concerning drunk driving; the laws are different depending on the number of offenses one has committed. And recently there were some new laws that were passed to help curb drunk driving. A few Senate Bills were passed regarding the Ignition Interlock program, which helps keep drivers from operating a vehicle while under the influence. There is also a new law for repeat offenders, now they get a zero tolerance treatment. This means that a person who is on probation for drunk driving cannot drive even if they have .01% on a BAC test.

The rules for DUI in California go as follows:

For the first offense, the person will have to go to jail for at least 4 days, but the time can be increased up to six months. The usual fine is around 400 dollars but can be up to a thousand dollars. Your license suspension would be for a period of six months but it can be given back with special restrictions. The offender will have to undergo a state program for drunk driving.

The second offense gets him 3 month jail time at least and if the circumstances warrant it the person can be convicted for a full year. The fine will be the same as the first offense. You will be forbidden to drive for up to a full year. In order to gain back your license you have to prove that you have undergone a program approved by the state to help a person with this drunk driving problem.

Third DUI conviction costs the offender 120 days or sometimes even up to a year in jail. The fine stays the same as it did with the previous convictions. And for the three years afterwards, their status as a driver will be unfavourable. Their license will be taken away for two years. Sometimes, the court can give the license back early with certain restrictions.

If the offender still doesn’t seem to understand and gets a fourth DUI, he will go to jail for six months and sometimes even for a year, which is the maximal sentence. Your license will be invalid for the three following years. A DUI program is mandatory to get his license back. There are also some laws for people addicted to drug and alcohol that are driving while on the effect of it.
