DUI Colorado

In Colorado, there are two different categories of drunk driving charges. First is the usual DUI (Driving Under the Influence) conviction, which happens when a person drives with a BAC of .08% or over. Then there is the DWAI (Driving While Ability Impaired) charge when you drive with a Blood Alcohol Content of between .05% and .07%. Plus the penalties increase depending on the number of times you have been convicted.

For the first DUI offense, the offender gets a fine between $300 and $1000. The minimum jail time is five days but if the court sees fit, they can convict the offender for a maximum time of a full year. And there is also community service that can go from 48 hours to 96 hours. Their license will be suspended for over a year. The second offense is a bit more costly for the offender. The fine starts at $500 but can go up to $1500 under certain circumstances. The jail time is at least ninety days but can go up to a year. The public service sentence is mandatory and will start at 60 hours and can be maximally 120 hours.

Now for the DWAI conviction, the first offense will cost the offender a minimum of $100 and a maximum of $500. The prison time required with the first offense is of at least 2 days up to 180 days. Community service is also a mandatory process and it can go from 24 hours to 48 hours. The second DWAI offense costs the offender at least $300, and it can also go up to $1000. The mandatory jail time is 45 days and public service is from 48 to 96 hours.

If a person addicted to alcohol or drugs gets charged with a DWAI while having a previous DUI conviction, the fine will be between $400 and $1200. Sixty days in jail is mandatory and at least 52 hours of community service will be required. There is also a specific penalty if you get charged for DUI while having a previous DWI charge. The cost is 450 dollars and can get to 1500 dollars. The offender will have to spend 70 days in jail, but under certain circumstances the jail sentence could be increased to a full year. Their license would also be suspended for a full year.
