DUI Delaware Drug & Alcohol Rehab Treatment
The following are the penalties for the DUI offenses in the state of Delaware. The first DUI offense will get your license revoked for a whole year. If you follow the First Offender Program Election, an official Delaware program, the suspension could be decreased. There is also a fine that comes with the penalty, and this fine for first time offenders is 230 dollars, and the maximum fine is of $1,150. You will also have to spend two months in jail, which the mandatory time, but the sentence could be increased up to 6 months.
If you have a second DUI conviction, your license will be revoked for a total of 18 months if your BAC is between .08% and .15%. If it’s higher than that, the license revocation will go up to 2 years, but if your Blood Alcohol Content is .20% or more, the suspension will last for 30 months. There is also a fine that comes with the second DUI which start at $575 and can go up to $2,300. There is a mandatory jail sentence of 60 days, but you could get convicted for up to eighteen months. The ignition interlock device is also required at this stage.
For the third DUI offense, if your BAC is lower than .16%, your license suspension would be of two years. Higher than that, your license would be suspended for thirty months, and higher than .20% there is a suspension of thirty-six months. The cost for a third DUI is at least $1,000. and can increase to $3,000. You will go to jail for a year at least, sometimes even two. There is still the mandatory ignition interlock device that will need to be installed on your vehicle(s).
When you get a fourth DUI offense, it is actually a Felony in the state of Delaware. The license suspension time will have to be determined by the judge. The fine you will have to pay would be at least $2,000. and the maximum is $6,000. You will have to spend at least 2 years in prison, but the sentence could be increased to 5 years. The ignition interlock device is also part of the plan.
So with these laws and penalties, the state of Delaware is looking to curb the epidemic of drunk driving. There are penalties and laws for people addicted to drug and alcohol that are driving while on the effect of it.
