DUI Hawaii Drug & Alcohol Rehab Treatment
Hawaii has precise consequences when it comes to DUI convictions. As soon as the first offense, the driver will have to go through a 14 hour program to educate him on drunk driving, this is used as a means to curb drunk driving in Hawaii. There are different levels of sanctions depending on your BAC level, if it is higher or lower than .15%. If it is lower, his license suspension will be between 3months and a year. But if it is higher than .15, the suspension starts at 6 months and could go to a year. Between 2 and 5 days of jail are going to be assigned to the offender. It will also cost him between 150 dollars and a thousand dollars.
Second DUI conviction will get one’s license revoked for at least a year, and even two years under certain circumstances. And the offender will either have to go to jail for a period of 5 to 14 days and pay 500 to 1,500 dollars or do 240 hours of community service. The offender will also have to go through the DUI program again. The minimum time to spend in that program is 14 hours.
If the offender gets a third conviction for DUI, the state will revoke your license for at least a year and that could go up to five years. This time, the offender will have to pay between $500 and $2,500 and jail time is mandatory, the sentence will be from 10 to 30 days. If there was a minor in the vehicle that was 15 years old or less, it will cost five hundred dollars more to the person and an additional 2 days in jail for each minor there at the time of the conviction.
For a fourth conviction, the offender becomes a “Habitual Offender” and will be seen that way by state of Hawaii from now on. The offender might have to go to prison for 5 years, and afterwards be on probation for 5 years. But this is only if the court sees fit. But there is however a mandatory suspension of a year at least, and 10 days of jail time is for sure and the offender will also have to receive DUI counselling. And the costs of that counselling will have to be covered by the felon. There are also some laws and penalties for people addicted to drug and alcohol that are driving while on the effect of it.
