DUI Idaho Drug & Alcohol Rehab Treatment

The first DUI offense is seen as a misdemeanour by the state of Idaho, for which the maximum jail sentence is 6 months. They might request that the offender pay a $1000 fine. At least a month of license suspension will be put on the offender, but the court often suspends it for longer, it can actually be extended from 2 to 5 months. Sometimes the offender will be allowed to drive but with strict restrictions.

There is a mandatory jail time for the second offense of a DUI kind, and it is of 10 days but can go to a full year and be fined $2,000 maximum. After the offender gets out of jail, they will not be allowed to drive for at least a full year. There is also a possibility to be requested to install the interlock ignition device in their car, after the suspension is up of course. There is no possibility of having restricted privileges on the second offense.

If the offender gets convicted for a third time, the maximum time to have spent in a penitentiary is ten years. If the court decides not to send the offender to the penitentiary, a mandatory month of county jail will happen. The fine could be up to 5,000 dollars and you won’t be allowed to drive for at least a year and that could go up to five years if the court thinks it best. There is also a mandatory interlock device that the offender has to have installed in his car(s).

The state of Idaho doesn’t have specific laws for a fourth conviction because of DUI, but repeat offenders are not very well seen, especially if you are under the age of 21. The laws are a lot stricter when people under 21 get charged with DUI. There is also a charge that can be held against the person addicted to drugs and alcohol if you refuse to provide the necessary sample for the officials to conduct a BAC test.
