DUI Kentucky Drug & Alcohol Rehab Treatment

The first time the driver will have to pay a fee of 200 to 500 dollars. The mandatory jail time is two days, but the court can sentence the offender to up to 30 days in jail. Those days can be converted in community service time if the court decides it. The driver’s license will be suspended for one to four months. There are certain circumstances that bring about more severe consequences. Those circumstances are things like driving 30 miles over the limit, going in the wrong direction on the road, etc. Under those circumstances, it is considered an aggravated DUI offense and the driver will have to spend 4 days in jail.

The second time a driver gets a DUI; he will have to pay between 350 and 500 dollars. Prison time will have to be between one week and six months. There is also a possibility that the offender will have to give 10 to 180 days of community service. His license will be suspended for 2 to 3 years. If there is a situation of aggravated DUI mentioned above that will get the driver 2 months in jail.

If the driver still insists on committing DUI and gets caught for a third time, it will cost him between 500 and 1,000 dollars. The state will also request that he go through one year of alcohol and substance abuse treatment. The prison time and community service are the same as the second offense. The license suspension is also the same as the second offense. On an aggravated DUI charge, 2 weeks in jail will be required.

The fourth DUI conviction is considered a Class D Felony by the Kentucky State. The felon will have to go to jail for 120 days with no possibility of probation. There will be a year of alcohol treatment requested and it also apply to people addicted to drugs or alcohol. Community service for at least ten days will be required. There will be a sentence of 60 days in jail if the circumstances cause it to be an aggravated DUI.
