DUI Nebraska Drug & Alcohol Rehab Treatment
The state of Nebraska has some of the toughest DUI laws in the United States. The state beverage is Kool-Aid, but don’t get caught mixing with alcohol while driving. Nebraska DUI law states if your blood alcohol content is that of .08%, you can be charged with a criminal offence. This percentage constitutes that of being impaired, and you can also be prosecuted while driving under the influence. This can only happen if you are proven to have been driving in an unsafe manner.
The evidence that can be used is the following:
- Slurred speech
- Blood shot/watery eyes
- Un-balanced co-ordination
- Hazardous driving
- Field sobriety tests
Even if you have not been drinking, but are under the influence of some benign substance or source, you can still be charged, and your license can be subject to automatic license removal.
After you have been charged in the state of Nebraska, you will have to face the criminal courts and the Nebraska Department of Motor Vehicles. If the arresting officer did suspend your license, or it was confiscated, you will be given a formal hearing. If you do not appear to this hearing, your license will be suspended, and you can also face further penalties. You can also request an administrative hearing with the DMV to request to get your license back. The state of Nebraska also has an out of state driver’s license compact agreement. This means that if you are from another state and you are caught drinking and driving in Nebraska. The state will report the charge to your home state where you can face further charges and penalties.
The state of Nebraska has the following blood alcohol content laws that state, all drivers with a blood alcohol content of .08% or higher can be charged. If a driver under the age of 21 is pulled over and has a blood alcohol content of .01% or of any detectable amount is found, that person will be charged. Any driver of commercial vehicles with a blood alcohol content of .04% or higher will be charged if pulled over. There are penalties and laws for people addicted to drug and alcohol that are driving while on the effect of it.
