DUI New Hampshire
The state of New Hampshire has a state motto that says ‘live free or die’. The ‘per-se’ law of New Hampshire is, if your blood alcohol content is that of .08%, you can be charged with a criminal offence. This percentage constitutes that of being impaired, and you can also be prosecuted while driving under the influence. This can only happen if you are proven to have been driving in an unsafe manner.
Every citizen who does receive a license in New Hampshire automatically gives consent for BAC, or Blood Alcohol Content Tests. This means that your blood, breath, and urine can be tested if you are under the suspicion of being under the influence of either drugs or alcohol. Local and state law officials take a zero tolerance approach to this. Drunk driving in the state of New Hampshire is considered to be serious offence, as it is in other states. If you are caught driving in a unsafe manner, the following evidence can be used against you in your conviction.
The evidence that can be used is the following:
- Slurred speech
- Blood shot/watery eyes
- Un-balanced co-ordination
- Hazardous driving
- Field sobriety tests
Even if you have not been drinking, but are under the influence of some benign substance or source, you can still be charged, and your license can be subject to automatic license removal. After being charged with a DUI in the state of New Hampshire, you are going to face the criminal courts, and the New Hampshire Department of Motor Vehicles. If your license was suspended or revoked, you will be offered a formal hearing. You can make a request for an administrative hearing within a 30 day period to the DMV to try and save your license.
The state of New Hampshire also has an out of state driver’s license compact agreement. This means that if you are from another state, and you are caught drinking and driving in the state of New Hampshire. The charge will be reported to your home state, where you can face further penalties, and your license could be suspended. In the State of New Hampshire it is illegal to drive with blood alcohol content of .08% or above. There are also some laws for individuals addicted to drug and alcohol that are driving while on the effect of it.
