New York State is better known as the big apple; yet, has some very stiff DUI laws throughout the state. Besides being charged with a DUI in New York you can also be charged with a DWI, driving while ability impaired. The ‘per-se’ law states that a blood alcohol content of .05% through .07% is relevant evidence enough to be considered impaired. A New York DUI charge carries a heavier offense and a blood alcohol content of .08% can be considered being under the influences. Even if you have not been drinking, but are under the influence of some benign substance or source, you can still be charged, and your license can be subject to automatic license removal.
After being charged with a DUI in New York you will have to face the criminal courts and the New York Department of Motor Vehicles. If your license was suspended or revoked, you will have the chance to a formal hearing. You can also request an administrative hearing wit the DMV within a 15 day period to request to get your license back. If you do not appear to your formal hearing, or you fail at succeeding, your sentence will be carried out and you will be charged with a DUI.
Your first DUI offense in the state of New York is a misdemeanor, and you will receive a fine of $500 - $1000 and could spend up to one year in jail. Your driver’s license will be suspended for a minimum of 6 months, and you will pay a mandatory conviction surcharge. Your second DUI charge in the state of New York will cost you $1000 - $5000 and will be considered a felony. You will have a minimum jail sentence of ten days and 60 days of community service. This jail sentence can be increased up to seven years, and your driver’s license will be revoked for one year, plus you will have an ignition interlock device installed in your vehicle.
Your third drunk driving charge in the state of New York will be considered another felony with a fine of $2000 - $10,000. You will also have to serve seven years in jail, and also 60 days of community service. Your license will be revoked for one year, and you will have an ignition interlock device installed in your vehicle. The state of New York prohibits driving with a blood alcohol content of .08% or higher, and this is considered driving impaired. The laws for drivers under the age of 21 are that of zero tolerance, and this applies for both people addicted to drugs and alcohol.
