DUI North Dakota Drug & Alcohol Rehab Treatment

The state of North Dakota is known as the peace garden state, and Dakota is a Sioux Indian word meaning friend. However, DUI laws in North Dakota are very severe, and there are some heavy penalties when caught. The ‘per-se’ law of North Dakota is, if your blood alcohol content is that of .08%, you can be charged with a criminal offence. This percentage constitutes that of being impaired, and you can also be prosecuted while driving under the influence. This can only happen if you are proven to have been driving in an unsafe manner. The evidence that can be used is the following:

  • Slurred speech
  • Blood shot/watery eyes
  • Un-balanced co-ordination
  • Hazardous driving
  • Field sobriety tests

Even if you have not been drinking, but are under the influence of some benign substance or source, you can still be charged, and your license can be subject to automatic license removal.

After being charged with a DUI in North Dakota, you are going to face the criminal courts and the North Dakota Department of Transportation, Motor Vehicles Division. If your license was suspended or revoked you will be offered a formal hearing. These suspensions are usually carried out by the motor vehicle division; yet, you can make a formal request for an administrative hearing to try and get your license back. North Dakota also has an out of state drivers license compact agreement, which means if you are from another state and you are caught drinking and driving, your home state will be informed where you can face further penalties.

When you are convicted and charged for the first time in North Dakota, there will be a $250 fine and your license will be suspended for 180 days. If you are addicted to drugs or alcohol. You could also be sent to a drug and alcohol treatment facility. Your second offence will land you a $500 fine, and one year suspension of your license. You will also receive five days in jail and 30 days of community service. The third time you are charged and convicted in the state of North Dakota, you will receive a three year suspension of your license. You will also be fined $1000, and serve 60 days in jail. The court will then order you to attend a drug and alcohol rehabilitation center.

The fourth time you are charged and convicted in North Dakota, your license will be suspended for three years, and you will pay a fine of $1000 and serve 180 days in jail. You will also have to attend an addiction treatment facility in order to have your license returned to you. The fifth time you are charged and convicted in North Dakota, you will be charged with a felony, and you will face five years in jail, and fined $5000.
