DUI Oregon Drug & Alcohol Rehab Treatment

The state of Oregon is famous for the Oregon Trail, which was a trail that opened up the entire Western United States. Unfortunately, Oregon does have a huge problem with drunk drivers on its freeways, and an increasing amount of alcohol related deaths. The exact charge that is laid is called driving under the influence of intoxication (DUI). The ‘per-se’ law of Oregon is, if your blood alcohol content is that of .08%, you can be charged with a criminal offense. This percentage constitutes that of being impaired, and you can also be prosecuted while driving under the influence. This can only happen if you are proven to have been driving in an unsafe manner.

Every citizen who does receive a license in Oregon automatically gives consent for BAC, or Blood Alcohol Content Tests. This means that your blood, breath, and urine can be tested if you are under the suspicion of being under the influence of either drugs or alcohol. so people addicted to drugs and alcohol should be careful. When you are charged in the state of you will have to face the criminal courts and the Oregon Department of Transportation, and the Motor Vehicles Services Division (DMV). If the arresting officer suspends your license, you have the right to a formal hearing. Within a 10 day period you can request an administrative hearing with the DMV to try and save your license. If you do not show up for your formal hearing your license will be taken away and you could face other penalties.

When you are charged and convicted for the first time in Oregon, the court will issue a one year suspension of your driver’s license. The court will then sentence you to 48 hours in jail and 80 hours of community service. The court will further fine you $1000 among other fees and fines, and you will have to also undergo a drug and alcohol assessment. Your second conviction in the state of Oregon will land a three year suspension of your driver’s license. You will have to serve one year in jail and pay a fine of $1500 among other fees, and you will be ordered to have a drug and alcohol evaluation done.

If by chance you are then charged and convicted a third time in the state of Oregon, you will spend one year in jail. There will be a fine of $2000 along with other fees and fines, and you will then have to undergo a drug and alcohol assessment. The DUI laws in Oregon are, if you are driving under the influence and you blood alcohol content is .08% or over, you will be charged. If you are under the age of 21, and you are caught driving under the influence and your blood alcohol content is that of .02% or over, you will be charged. Of you are a commercial truck driver and you are caught driving under the influence, and you blood alcohol content is that of .04% or higher, you will be charged. The state of Oregon, like most states has taken a zero tolerance to drunk driving. This is to make sure people’s lives are protected and the roads are kept safe.
