DUI Pennsylvania Drug & Alcohol Rehab Treatment
The state of Pennsylvania sets its DUI laws under an unusual set of circumstances. The charges are based on the results of the blood alcohol content tests and the persons past convictions, if any, in the state of Pennsylvania or out of the state. There are three categories of blood alcohol content: .08% to .099%, .10% to .159%, and .16% and higher. Also included are penalties for refusing to take a BAC test. The ‘per-se’ law of Pennsylvania is, if your blood alcohol content is that of .08%, you can be charged with a criminal offense. This percentage constitutes that of being impaired. This particular law also relates to driving under the influence of drugs (DUID). If you have any amount of drugs in your system, you can be charged with this offense. These laws applies to people either addicted to drugs or alcohol.
Every citizen who does receive a license in Pennsylvania automatically gives consent for BAC, or Blood Alcohol Content Tests. This means that your blood, breath, and urine can be tested if you are under the suspicion of being under the influence of either drugs or alcohol. This can only happen if you are proven to have been driving in an unsafe manner.
The evidence that can be used is the following:
- Slurred speech
- Blood shot/watery eyes
- Un-balanced co-ordination
- Hazardous driving
- Field sobriety tests
Even if you have not been drinking, but are under the influence of some benign substance or source, you can still be charged, and your license can be subject to automatic license removal.
When you are being charged and convicted in the state of Pennsylvania for the first time, you will receive six months probation and a $300 fine. Depending on your blood alcohol content at the time of being charged, you could face up to six months in jail and the fine will increase. Your second offense will be at least six months in jail and a $300 - $2500 fine. Depending on your blood alcohol content at the time of being charged, these fines and jail time will go up. The third time you are charged and convicted of a DUI in Pennsylvania, you will be going to jail for two years, and will start with a fine of $500 - $5000. These fines and jail times will increase, depending on your blood alcohol content at the time of being charged. On every second and third offense, you will be ordered to install an ignition interlock device in your vehicle.
