The ‘per-se’ law of Wyoming is, if your blood alcohol content is that of .08%, you can be charged with a criminal offense. When you are charged with a DUI offense in the state of Wyoming, you may face criminal court, and the Wyoming Department of Transportation (WDT). Through all of this the convicted will have their license suspended, and will be offered a formal hearing. If they choose not to take the formal hearing they can face other consequences. The convicted person will most likely lose their license, and if this person is visiting from another state and is charged in Wyoming, the state will report this charge to the individual’s home state, where they can face further consequences.

Your first DUI offense in the state of Wyoming when arrested and convicted will consist of your license being suspended for 90 days. You will also face up to six months in jail, and a $750 fine, and will have to have a substance abuse assessment. Your second offense within a five year period will bring a minimum of seven days in jail, with up to six months. You will have to under go a substance abuse assessment, a $750 fine, and have your license suspended for one year. There will also be a big possibility you will have to have an ignition interlock device installed. Your third offense of a DUI within a five year period will bring a minimum of 30 days in jail, with up to six months. You will have to attend an inpatient substance abuse program, and undergo an assessment. You will also face a $750 to $3000 fine, and have your license suspended for three years. You will also have to have an ignition interlock device installed in your vehicle.
