California Drug Treatment Laws and Standards Surround Substance Abuse Treatment

Within the state of California, specific state law and standards surround treatment services such as residential treatment centers, detox facilities, partial hospitalization programs, outpatient treatment centers, and sober living facilities. The Substance Use Disorder Compliance Division, which is part of the California Department of Health Care Services (DHCS), is the oversight for the substance abuse treatment resources within the state. The organization provides the monitoring, licensing and certification for California’s DUI programs, overall treatment programs, outpatient providers, and residential treatment providers. The Substance Use Disorder Compliance Division also responds to complaints against program providers and ensures compliance with criminal justice treatment programs.

The state must license any facility in California that provides detoxification, group or individual therapy sessions, addiction education sessions, and alcoholism or drug abuse recovery or treatment planning. According to the Substance Use Disorder Compliance Division, the residential treatment facilities that provide nonmedical services are not required to be licensed. Under the Fair Housing Act, the state of California considers individuals who are in treatment for drug or alcohol abuse to be disabled. Outpatient programs and partial hospitalization programs are held to the same standards and requirements as residential drug rehab centers. These types of programs require a license if they provide certain services, and do not need a license if they offer nonmedical treatment.
